The petition for the restraining order was originally filed by Emilio on April 8, after Francesco allegedly attempted to break into Frankie's home on April 5. According to the petition, Francesco "repeatedly physically threatened to harm or kill" Emilio while waiting for law enforcement to respond to the scene.
Emilio alleged that the altercation was part of a "pattern" of behavior by Francesco over the past months. He also accused his brother of being addicted to opiates and selling their father's personal property to pay for drugs.
Frankie, 90, expressed concern that Francesco would harm him due to the "constant threats of violence." Emilio wrote in the petition that Frankie had provided financial support to his son but had made it contingent on his entering a residential drug treatment program.
"Since cutting off respondent financially, respondent's threats have escalated as well as the sale of personal property of our father, and increased attempts to access the property of our father," the court docs read.
Frankie has three sons: Emilio, Brando, and Francesco, with his ex-wife Randy Clohessy. Emilio filed the restraining order petition on behalf of himself and his brother, Brando.
Francesco did not attend Frankie's Hollywood Walk of Fame ceremony on May 3, which was attended by Emilio and Brando. Frankie expressed his gratitude for their presence and the support of his wife, Jackie, whom he married in 2023.
"This is really a highlight of my life, especially having my sons here and my wife sitting right there," he told the crowd, according to People magazine.
Frankie's legal representation and a representative for Francesco have been contacted for comment.
