In a resurfaced speech, Harris discussed the "Back on Track" program, which allowed non-violent offenders to avoid jail and enter job training instead. When asked about an illegal immigrant participant who went on to commit a robbery and assault a woman, Harris responded by saying, "It was a mistake or a glitch in the design."

Kiefer, whose skull was fractured during the attack, finds Harris' explanation unconvincing. "That 'glitch' certainly had a negative impact on my life," she said in a statement to Fox News Digital. "It would be easier to believe it was a mistake if Democrats in San Francisco didn't have a long history of enabling illegal immigration and choosing not to prosecute illegal immigrant criminals."

Kiefer pointed to the Biden-Harris administration's influx of millions of illegal immigrants, including tens of thousands of convicted criminals and those on the terror watch list, as evidence of what she believes is an intentional policy of undermining American safety. "At a certain point, it can't be incompetence," she said. "It's intentional. Harris doesn't care about Americans' safety."

Harris, in her 2010 speech at UC Berkeley, acknowledged the risk associated with criminal justice innovation. "The fear will always be that guy will go out and kill a baby and a grandmother tomorrow," she said. "And then everyone will look backwards and say, 'Why didn't you do it the way it's always been done?'"

However, Kiefer believes that Harris' program went beyond acceptable risk. "When you're releasing someone who has already committed a crime, you're taking a chance that they will commit another one," she said. "And that's exactly what happened in my case."
