Yoo, who served in the George W. Bush administration, made the remarks during a Fox News interview. He questioned why the DOJ had not yet launched an investigation into potential violations of the Foreign Agents Registration Act (FARA). FARA requires individuals and entities acting on behalf of foreign governments or political parties to register with the DOJ.

Hunter Biden has been accused of using his father's position as vice president to benefit his business dealings in Ukraine. He served on the board of Burisma Holdings from 2014 to 2019, a period during which his father led US-Ukraine policy.

Yoo argued that there was ample evidence to suggest that Hunter Biden may have been acting as an unregistered foreign agent for Burisma Holdings. He pointed to Hunter Biden's undisclosed meetings with Ukrainian officials and his efforts to arrange meetings for Burisma Holdings with US government officials.

Yoo also expressed shock over the slow pace of the DOJ's investigation into Hunter Biden's dealings with Burisma Holdings. He noted that the investigation had been ongoing for several years but had not yet produced any charges.

Yoo questioned whether the investigation was being intentionally slow-walked ahead of the 2024 presidential election. He suggested that the DOJ may be reluctant to indict Hunter Biden due to his father's position as president.

Merchan ruled that he had no personal bias against Trump and that he would be able to preside over the case fairly. Yoo said that he respected Merchan's decision but believed that Trump had a legitimate basis for requesting his recusal.
