Heitmann initially claimed that she had only one glass of wine, and repeatedly stated she was not intoxicated. She declined the officer's request to remove her heels, optting to do the test in them.

During the test, Heitmann swayed and had difficulty maintaining her balance. She also exhibited slurred speech and had difficulty following instructions.

Upon completion of the test, the responding officers determined there was probable cause to arrest Heitmann for driving under the influence of an intoxicating substance. She was transported to Naples Jail Center, where she agreed to participate in a breathalyzer test.

The breathalyzer test revealed that Heitmann had a BAC of 0.155 and 0.169, while the legal limit in Florida is 0.08.

Heitmann was arrested and charged with DUI. She was later released on bond.
