Appearing in court, Weinstein was dressed in a blue suit and tie adorned with an American flag pin. The hearing focused on various aspects of the retrial, including the admissibility of text message evidence against him.

After the hearing, Weinstein's attorney, Diana Fabi Samson, addressed reporters outside, stating that her client "is anxious to go to trial and prove his innocence." Samson also expressed concerns about Weinstein's health, noting that he "is not well, and that has affected his mental state."

During a previous hearing on July 9, prosecutors informed the judge that an investigation into Weinstein is ongoing following allegations from multiple accusers. Assistant District Attorney Nicole Blumberg clarified that a grand jury had not yet been convened as part of the investigation. Weinstein's defense team asserted that the ongoing investigation was a mere delay tactic employed by the prosecution.

However, the Manhattan District Attorneys Office firmly denied the accusation, stating that "there’s certainly no delay tactics on our part. We’re proceeding in the most expeditious manner."

In April 2023, a New York appeals court overturned Weinstein's 2020 rape conviction and ordered a new trial. The 4-3 decision concluded that the trial judge had allowed prosecutors to call witnesses who testified about alleged assaults unrelated to the specific charges against Weinstein.

Weinstein was initially sentenced to 23 years in prison after a 2020 conviction for forcing oral sex on a production assistant in 2006 and third-degree rape of a hairstylist in 2013. He was acquitted of first-degree rape and predatory sexual assault allegations made by actress Annabella Sciorra.

The appeals court found that the trial judge should have limited witness testimony to incidents directly connected to the charges. Multiple women had testified about sexual encounters with Weinstein that were outside the scope of the prosecution's case.

Following Weinstein's sentencing in New York, he was extradited to California in 2021 to face sexual assault charges from four women in Los Angeles and Beverly Hills. As a result of the overturned conviction, California has requested Weinstein's extradition to begin serving his 16-year sentence.

Weinstein's defense team has opposed the extradition, citing concerns about their client's health and the need for him to prepare for his upcoming trial in New York. Weinstein's next hearing related to the matter is scheduled for August 7.
